By visiting, viewing or ordering from our website you agree to acknowledge and be bound by the Terms and Conditions outlined in this agreement.

This Agreement outlines the trading Terms and Conditions bound to all BikeBox (Quartra Pty Ltd trading as BikeBox) transactions incorporating but not limited to online, fax, phone and email ordering. Furthermore, this agreement outlines specific terms of use applicable to all aspects of our website.

The words we, us, our, BikeBox mean BikeBox of 7 / 136 Cochranes Rd Moorabbin Vic 3189. The words “you” and “your” refer to registered users, customers, resellers, associates, suppliers or general public visitors to our Web Site.

We may amend this Agreement at any time in our discretion by posting the amended terms on our Site. Any amendments to this document will be posted in the online News facility and welcome page. Except as stated below, all amended terms shall automatically be effective immediately after they are posted in the online News facility. This Agreement may not be otherwise amended except through a written request from you (signed) and agreed by us (signed). This agreement is effective on 2/03/2010.

  1. Governing Law
    1. The Terms and Conditions of this agreement are governed by the applicable statutory rules and regulations enforced in accordance with the laws, of the Federal Government of Australia and of the State of Victoria. The buyer agrees to submit to the jurisdiction of the Courts of Victoria.
  2. Intended Use
    1. All material including but not limited to text, images, multimedia, advertisements and downloadable content is published by us and made available to worldwide audiences. If you access this website outside of Australia, you do so at your own risk and you must comply with the rules and regulations enforced by your respective jurisdiction.
    2. You agree differing terms and conditions exist between local (Australian) and international customers.
    3. The general public of all ages may view all publicly available material and only copy it for personal use. You may only use material for commercial purposes when you have prior written consent from BikeBox.
    4. Registered users may be but not limited to general public, employees or representatives of companies, associations, governments or any other corporate entity.
  3. Disclaimer and Limitation of Liability
    1. All material on our website is provided to you "as is" and "as available". We do not warrant or guarantee the accuracy, adequacy or completeness of this material, and expressly disclaim liability for mistakes, misleading or absent information.
    2. To the maximum extent permissible by law and unless otherwise specified, we do not warrant, guarantee or make any representations and warranties of any kind, whether express, implied or statutory.
    3. Whilst we promise to actively combat malicious activities, we do not warrant, guarantee or make any representations our website will be safe from such behaviour including but not limited to viruses, hackers or denial of service attacks. Furthermore, we do not warrant, guarantee or make any representations that our website will be fully accessible at all times and disclaim any loss or damages as a result of it being unavailable.

To the maximum extent permitted by law, we disclaim liability for any damages, including, without limitation, direct or indirect, special, incidental, compensatory, exemplary or consequential damages, losses or expenses, including without limitation lost or misdirected orders, lost profits, lost registrations, lost goodwill, or lost or stolen programs or other data, however caused and under any theory of liability arising out of or in connection with (1) use of this site, or the inability to use this site by any party; or (2) any failure or performance, error, omission, interruption, defect, delay in operation or transmission; or (3) line or system failure or the introduction of a computer virus, or other technical sabotage, even if we or our employees or representatives are advised of the possibility or likelihood of such damages, losses or expenses.
  4. Methods of Ordering
    1. Internet
      Ordering over the Internet enables customers to access real time pricing and information of our entire product range, it also allows you to view order history, create regularly ordered product templates and many other features to save time and effort.
      1. All online orders are treated as an express intention to purchase the nominated goods (Purchase Order) for the agreed online prices.
      2. You accept that other than Freight on Board (FOB) all other freight charges will not be included with your online purchase order. See Terms and Conditions of Delivery below.
      3. We reserve the right to alter the agreed price if an incorrect price was caused by a software fault, error or malicious attack.

      All phone or email orders are treated as an express intention to purchase the nominated goods (Purchase Order) for a previously quoted price.
  5. Pricing
    1. Unless otherwise specified, all prices on our website are quoted in Australian Dollars (AUD).
    2. Listed prices are displayed Excluding GST & freight or other taxes where applicable.
    3. All prices are subject to changes without prior notice.
  6. Order Process
    1. Unless previously quoted, you accept that any freight charges will be added to your order.
    2. In most cases, your order will be processed and dispatched within 48 hours unless otherwise advised. During trade fairs periods, please expect a longer dispatch time.
    3. Please call us on (03) 9555 5800 if you have not received your order within 7 working days of placing your order or if you have any concerns at all.
    4. Items not supplied will be placed on back order. Back orders, with freight to your account, will be filled as soon as stock is available. Please indicate on your purchase order if backorders are not accepted.
  7. Methods of Payment

      Over the phone credit card VISA and Master CardDirect Deposit Telegraphic Transfer
      A payment is considered complete when the funds have been cleared.
    2. On account. We only accept payment on account where an account application has been lodged and approved by BikeBox. Approval results in credit Terms being available. BikeBox standard terms are a 30 day account, from end of month of the date the invoice was created.
      In the event where this account is not paid within the trading terms provided the following shall apply:
      1. BikeBox shall without prejudice to any other remedies available to it be entitled to charge interest on the amount outstanding calculated from the date payment is due until the date payment is made on the amount outstanding from time to time at the interest rate prescribed by reference to the Penalty Interest Rates Act (Vic) from time to time plus five percent (5%).
      2. In the event where the Customer fails to pay the whole amount due within seven (7) days of being so requested to do so by the BikeBox in writing then BikeBox shall be at liberty to instruct a Collection Agency and/or Solicitors to recover monies outstanding and the Customer shall be liable for any costs charges commissions and expenses reasonable and properly payable by BikeBox to such Collection Agency and/or Solicitors relating to the recover of such sum;
      3. Any monies recoverable by BikeBox from the Customer pursuant to sub clauses (a) and (b) shall be added to the amount otherwise due and shall be recoverable as a liquidated debt.
      Bikebox reserves the right without prejudice to any other remedy it may have, either to terminate the contract or to suspend future deliveries until all outstanding monies (including any service charges) are paid. If in BikeBox’s opinion the customer financial status become unsatisfactory to Bikebox , BikeBox reserves the right to require payment of the price in advance.A payment is considered complete when the funds have been cleared.
  8. Delivery
    1. Inside Australia: Orders sent within Australia will be sent by courier.
    2. Documentation: An itemised Tax Invoice containing a description of goods purchased and freight charged accompanies all orders.
    3. Final Delivery: All orders both domestic and international will only be delivered to a business or residential address and require a signature upon receipt. We do not accept post office box addresses.
    4. Insurance: Goods are the responsibility of the buyer once they have been dispatched. If goods are to be insured, the Buyer must notify BikeBox at the time of placing the order. These costs will be charged to the Buyer.
    5. Couriers - BikeBox will endeavour to ensure a prompt and cost effective method for delivery. Generally all freight is organised by Bikebox and charged according to weight and / or cubic volume. Buyer specific requirements must be notified at the time of placing the order.
    6. Own courier - if you choose to use your own courier, please note that you are liable for all charges imposed by your courier.
    7. BikeBox does not accept the responsibility for delayed OR missing items/packages.
    8. Depending on your location, shipping times will vary. Should your request be high priority please ensure this noted at the time of placing the order.
  9. Returns
    1. If no claim has been made by the Buyer within 7 days it is assumed that the delivery is complete and correct and the Buyer is responsible for payment of the goods.
    2. All claims / returns must be notified in writing (by fax or?email) within 5 working days of receipt of goods.
  10. Claims for damage or missing goods
    1. If no claim has been made by the Buyer within 7 days it is assumed that the delivery is complete and correct and the Buyer is responsible for payment of the goods.
